Does SSA consider working over SGA for 5 years as an improvement to your medical condition?
Your best bet is to work with a lawyer that specializes in filing for disability. You will not be paying anything up front and the government regulates how much they can take from back settlements. There are always appeals processes in SS all the way up to a hearing with a law judge. Even if you go into their office, sometimes you get varying answers depending on who you talk to. If you get denied, there is a long wait for appeals to be heard so you are definitely better talking to someone who files these claims all the time. Its really important to do everything right the first time to avoid appeals. It is my understanding that you have to have paid into SS during the five years prior to your SSDI claim otherwise you may end up with just SSI which is less money and you may not be eligible for Medicare.
